These Terms of Use ("Terms") constitute a legally binding agreement between you ("you", "your", or "User") and Fun Ideas Limited, a company incorporated under the laws of the Republic of Cyprus, with its registered office at Mairoza Court 6, Flat 1, 6 Favierou, Limassol 3107, Cyprus ("Almy", "we", "our", or "us"), governing your access to and use of the Almy mobile application, website, and all related services (collectively, the "Services").

Please read these Terms carefully before using the Services.

By downloading, installing, accessing, creating an account, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not access or use the Services.

01. Introduction

Almy is a parenting and baby development application designed to help parents and caregivers monitor various aspects of a child's early development, daily routines, growth, feeding, sleep, health-related observations, milestones, and other family records.

The Services are intended solely as informational and organizational tools that assist parents and caregivers in recording and reviewing information about their child.

Almy is not a healthcare provider, medical organization, hospital, emergency service, medical device manufacturer, or licensed healthcare professional.

Nothing within the Services is intended to replace professional medical advice, diagnosis, treatment, or individualized recommendations from qualified healthcare providers.

Your use of the Services is entirely voluntary and at your own discretion.

02. Eligibility and Acceptance of These Terms

You may use the Services only if:

  • - you are at least eighteen (18) years of age or have reached the age of legal majority in your jurisdiction;
  • - you have the legal capacity to enter into a binding agreement;
  • - you are using the Services on your own behalf or on behalf of your minor child or another child for whom you are legally authorized to provide care;
  • - your use of the Services complies with all applicable laws and regulations.

03. Important Health / Medical Disclaimer

A. No Medical Advice

The Services are provided solely for educational, informational, and organizational purposes.

Nothing contained within the Services constitutes:

  • - medical advice;
  • - medical diagnosis;
  • - treatment recommendations;
  • - healthcare services;
  • - nursing advice;
  • - pediatric advice;
  • - emergency medical guidance;
  • - psychological counseling;
  • - nutritional counseling;
  • - professional healthcare services of any kind.

Any information presented within the Services, including articles, growth charts, developmental milestones, sleep recommendations, feeding guidance, symptom descriptions, AI-generated insights (if available), reminders, notifications, or educational materials, is intended only as general information. Such information may not be applicable to your individual child.

B. Individual Child Development

Every child develops differently.

Developmental milestones, growth expectations, sleep patterns, feeding schedules, behavior, weight gain, height, head circumference, motor skills, language development, and other indicators vary significantly between children.

The information presented by the Services should never be interpreted as confirmation that your child is developing normally or abnormally.

Likewise, the absence of a milestone, delayed development, differences in growth, or unusual patterns recorded within the Services do not necessarily indicate the existence of a medical condition.

Only qualified healthcare professionals can properly evaluate a child's health and development.

C. No Emergency Use

The Services are not designed or intended for emergency situations.

Do not use the Services to determine whether emergency medical care is necessary.

If you believe your child may be experiencing:

  • - difficulty breathing;
  • - seizures;
  • - unconsciousness;
  • - severe allergic reactions;
  • - poisoning;
  • - dehydration;
  • - serious injury;
  • - high fever requiring urgent evaluation;
  • - persistent vomiting;
  • - or any other potentially life - threatening condition,

immediately contact your local emergency services or seek professional medical assistance.

Never delay seeking medical care because of information provided by the Services.

D. No Medical Monitoring

Almy does not continuously monitor your child.

We do not review, supervise, analyze, validate, or respond to health information that you enter into the Services.

Unless explicitly stated otherwise, no healthcare professional reviews your child's records.

The Services do not generate medical alerts or emergency notifications.

E. User Responsibility

You remain solely responsible for all decisions concerning your child's health, nutrition, sleep, development, medication, and medical treatment.

You should always consult qualified healthcare professionals regarding questions about your child's health.

F. Accuracy of Information

Although we strive to provide accurate and up-to-date educational materials, medical knowledge continuously evolves.

We do not guarantee that any information available through the Services is complete, current, accurate, or suitable for your particular circumstances.

04. Intended Use

The Services are intended exclusively for lawful personal and non-commercial use by parents, guardians, caregivers, and families.

Subject to these Terms, Almy grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services solely for their intended purpose.

You may use the Services to:

  • - record your child's daily activities;
  • - monitor sleep, feeding, diaper changes, pumping, growth measurements, developmental milestones, medications, appointments, and other childcare information;
  • - review educational content;
  • - organize parenting - related information;
  • - receive reminders and notifications;
  • - synchronize data across your own devices;
  • - share selected information with authorized family members or caregivers where such functionality is available.

The Services are not intended for:

  • - professional medical practice;
  • - clinical decision - making;
  • - hospital use;
  • - emergency response;
  • - diagnostic purposes;
  • - treatment planning;
  • - research involving protected health information;
  • - commercial childcare services unless expressly authorized.

Any use beyond the intended purposes may result in suspension or termination of your access.

05. User Accounts

Certain features require creation of an account.

When creating an account, you agree to provide accurate, current, and complete information and to keep that information updated.

You are responsible for maintaining the confidentiality of your login credentials.

You agree not to:

  • • share your password with unauthorized persons;
  • • allow others to access your account except through authorized sharing features;
  • • create multiple accounts to circumvent restrictions;
  • • impersonate another individual;
  • • provide false identity information.

You are responsible for all activities occurring under your account.

If you believe your account has been accessed without authorization, you must notify us promptly.

We reserve the right to suspend, restrict, or terminate accounts that violate these Terms or that present security risks.

You may delete your account at any time through the application settings where available or by contacting us.

Deletion of your account may result in permanent deletion of associated data in accordance with our Privacy Policy.

06. Acceptable Use

You agree to use the Services responsibly and only for lawful purposes.

You shall not, directly or indirectly:

  • - violate any applicable law or regulation;
  • - use the Services for fraudulent purposes;
  • - interfere with or disrupt the Services or servers;
  • - attempt to gain unauthorized access to any account, database, or system;
  • - upload malicious software, viruses, worms, spyware, ransomware, or harmful code;
  • - reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Services;
  • - scrape, harvest, copy, or extract data from the Services using automated means;
  • - use bots or automated systems to access the Services;
  • - circumvent security measures or technical protections;
  • - exploit bugs or vulnerabilities;
  • - upload unlawful, defamatory, threatening, abusive, obscene, or otherwise inappropriate content;
  • - infringe the intellectual property rights of others;
  • - use the Services in any manner that could impair their operation or availability;
  • - resell, lease, sublicense, or commercially exploit the Services without our prior written permission;
  • - use the Services to develop competing products or services.

We may investigate suspected violations of these Terms and may suspend or permanently terminate access where appropriate.

07. User Content

The Services may allow you to create, upload, enter, store, organize, or otherwise submit information, including but not limited to your child's profile, developmental records, sleep logs, feeding records, growth measurements, diaper changes, medication records, notes, photographs, appointments, reminders, journal entries, and other materials (collectively, "User Content").

You retain ownership of all User Content that you submit to the Services.

Nothing in these Terms transfers ownership of your User Content to Almy.

However, by submitting or storing User Content through the Services, you grant Almy a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to host, store, reproduce, process, adapt, modify (solely as necessary for technical purposes), transmit, synchronize, display, and otherwise use your User Content solely for the purpose of:

  • - operating the Services;
  • - providing requested functionality;
  • - synchronizing your information across devices;
  • - enabling sharing features that you authorize;
  • - maintaining backups;
  • - improving system performance and reliability;
  • - protecting the security and integrity of the Services;
  • - complying with applicable legal obligations.

This license remains in effect only for as long as necessary to provide the Services or until your User Content is deleted, subject to our backup retention policies and legal obligations.

A. Your Responsibilities

You are solely responsible for all User Content that you submit.

You represent and warrant that:

  • - you own the User Content or otherwise have all necessary rights to submit it;
  • - you have the legal authority to provide information relating to any child whose information is entered into the Services;
  • - your User Content does not violate applicable laws;
  • - your User Content does not infringe the intellectual property, privacy, publicity, or other rights of any third party;
  • - your User Content does not contain malicious code or harmful software.

You acknowledge that Almy does not routinely review User Content before it is stored or processed.

B. Prohibited Content

You agree not to upload, submit, or transmit any User Content that:

  • - is unlawful;
  • - is fraudulent or intentionally misleading;
  • - contains malware or malicious code;
  • - infringes copyrights, trademarks, patents, or other intellectual property rights;
  • - violates privacy or confidentiality obligations;
  • - contains defamatory, abusive, threatening, hateful, discriminatory, or harassing material;
  • - promotes illegal activities;
  • - contains sexually explicit material;
  • - exploits or endangers children;
  • - violates any applicable law or regulation.

We reserve the right to remove or restrict access to User Content that we reasonably believe violates these Terms or applicable law.

C. Photographs and Media

If the Services allow you to upload photographs or other media, you remain the owner of such content.

You acknowledge that photographs may contain personal information and should only be uploaded if you are legally authorized to do so.

You are solely responsible for ensuring that any media you upload complies with applicable privacy laws and does not infringe the rights of any third party.

D. Data Accuracy

Many features of the Services rely on information that you voluntarily provide.

You are responsible for ensuring that information entered into the Services is accurate and updated as necessary.

Incorrect or incomplete information may affect the usefulness, recommendations, reminders, statistics, or educational content generated by the Services.

Almy assumes no responsibility for decisions made based on inaccurate information entered by users.

E. Shared Access

Where the Services permit you to share access with family members, caregivers, or other authorized individuals, you are solely responsible for determining whom you grant access to.

By sharing access, you acknowledge that those individuals may be able to view, modify, add, or delete User Content according to the permissions provided by the Services.

Almy is not responsible for actions taken by individuals to whom you voluntarily grant access.

You may revoke shared access at any time using available account management features.

F. Content Monitoring

Almy generally does not monitor User Content and has no obligation to review information submitted by users.

However, we reserve the right to investigate reports of unlawful or prohibited content and may remove, disable access to, or preserve User Content where necessary to:

  • - enforce these Terms;
  • - protect the rights, safety, or property of users or third parties;
  • - comply with legal obligations;
  • - respond to lawful requests from public authorities;
  • - prevent fraud, abuse, or security threats.

G. No Obligation to Preserve Content

While we make reasonable efforts to maintain reliable storage and backup systems, we do not guarantee that User Content will never be lost, corrupted, or unavailable.

You are responsible for maintaining copies of any information that you consider important.

To the fullest extent permitted by law, Almy shall not be liable for loss of User Content resulting from technical failures, software defects, user error, unauthorized access, force majeure events, or other circumstances beyond our reasonable control.

H. Deletion of User Content

You may delete certain User Content through the Services at any time.

Following deletion, some information may remain in secure backups or archived systems for a limited period where necessary for disaster recovery, legal compliance, fraud prevention, or enforcement of these Terms.

Our handling of deleted information is further described in our Privacy Policy.

08. Child Information and Development Data

The Services are specifically designed to help parents and caregivers organize information relating to infants and young children.

Accordingly, the Services may allow you to record information including, but not limited to: child's name or nickname, date of birth, biological sex, height, weight, head circumference, feeding history, sleep history, diaper changes, developmental milestones, health observations, photographs, notes, and other childcare-related information.

You acknowledge that this information is voluntarily provided by you.

You represent and warrant that you have all necessary legal authority to provide information concerning any child whose information is entered into the Services.

You remain solely responsible for ensuring that all information is accurate, complete, and up to date.

The Services do not independently verify the accuracy of any child-related information entered by users.

Developmental charts, milestone timelines, growth references, educational materials, and other informational content available through the Services are intended solely as general educational resources. They should not be interpreted as medical evaluations, diagnoses, developmental assessments, or professional healthcare advice.

Children develop at different rates, and individual variations are common.

The Services do not determine whether a child is healthy, developing normally, or requires medical attention.

Any notifications, reminders, milestone tracking, growth comparisons, educational articles, or informational summaries generated by the Services should always be interpreted together with professional medical guidance where appropriate.

You acknowledge that inaccurate or incomplete child information may reduce the usefulness of certain features or produce inaccurate statistics, reminders, developmental insights, or educational recommendations.

Almy does not sell or intentionally disclose child information except as described in our Privacy Policy or where required by applicable law.

09. Subscriptions, Fees, Auto-Renewal, and Refunds

Certain features of the Services may be available only through a paid subscription or other purchase (collectively, "Subscriptions").

Information regarding available subscription plans, pricing, billing periods, included features, and applicable taxes will be presented before you complete your purchase.

By purchasing a Subscription, you agree to pay all applicable charges associated with your selected plan.

A. Billing

Subscriptions may be offered on a weekly, monthly, annual, or other recurring basis.

Unless otherwise specified, subscriptions automatically renew at the end of each billing period until cancelled.

Your payment method will be charged automatically through the applicable app marketplace or payment provider.

You authorize the applicable payment processor to charge all recurring subscription fees and applicable taxes.

B. Auto-Renewal

Unless cancelled before the end of the current billing period, your Subscription will automatically renew for an additional subscription period of the same duration.

The renewal will occur using the payment method associated with your account through the applicable app marketplace or payment provider.

You may disable automatic renewal at any time through your Apple App Store account or Google Play account.

Deleting the application from your device does not cancel your Subscription.

C. Free Trials

Almy may offer free trial periods or promotional access to certain Subscription features.

Unless otherwise stated, once the trial period expires, your paid Subscription will begin automatically unless cancelled before the trial ends.

Eligibility for free trials is determined solely by Almy and may be limited to new users or specific promotional campaigns.

We reserve the right to modify or terminate any free trial offer at any time.

D. Price Changes

We may change Subscription prices from time to time.

Price changes will not affect your current billing period but may apply to future renewals where permitted by applicable law and the policies of the relevant app marketplace.

Where required by law or by the applicable payment platform, you will receive prior notice of any price changes.

E. Cancellation

You may cancel your Subscription at any time.

Cancellation prevents future renewals but does not automatically entitle you to a refund for the current billing period.

Following cancellation, you will continue to have access to Subscription features until the end of the prepaid subscription term.

Subscriptions purchased through Apple App Store must be cancelled through your Apple account.

Subscriptions purchased through Google Play must be cancelled through your Google Play account.

F. Refunds

Unless required by applicable law, all payments are non-refundable.

Refund requests for purchases made through Apple App Store or Google Play are governed by the refund policies of the respective platform.

Almy does not control refund decisions made by third-party payment providers.

Nothing in these Terms limits any mandatory statutory rights available under applicable law.

G. Suspension for Non-Payment

If payment cannot be successfully processed, we may suspend or restrict access to Subscription features until payment is successfully completed.

Repeated payment failures may result in cancellation of the Subscription or termination of the associated account.

H. Taxes

You are responsible for any taxes, duties, levies, or similar governmental charges applicable to your purchase, except where such amounts are already included in the displayed purchase price.

10. Ownership and Licenses

The Services, including all software, source code, databases, algorithms, user interfaces, designs, graphics, icons, illustrations, animations, logos, trademarks, service marks, text, educational materials, articles, audio, video, documentation, compilations, and all other content made available through the Services (collectively, the "Almy Content"), are owned by or licensed to Almy and are protected by applicable intellectual property and other laws.

A. Limited License

Subject to your compliance with these Terms, Almy grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services solely for your personal, non-commercial use.

This license does not permit you to:

  • - copy the Services except as necessary for normal use;
  • - modify or create derivative works;
  • - distribute, publish, sublicense, lease, rent, or sell any portion of the Services;
  • - remove copyright notices or proprietary markings;
  • - reverse engineer or attempt to discover the source code except where expressly permitted by law;
  • - use the Services to build competing products;
  • - exploit the Services for commercial purposes without our prior written consent.

B. Trademarks

"Almy", our logos, brand names, product names, slogans, graphics, and other identifiers are trademarks or registered trademarks of Almy or its licensors.

Nothing contained within the Services grants any right to use our trademarks without our prior written permission.

C. Reservation of Rights

All rights not expressly granted under these Terms are reserved by Almy and its licensors.

11. Third-Party Services

The Services may integrate with or provide access to third-party products, platforms, software, payment providers, analytics services, cloud providers, health platforms, authentication providers, customer support systems, or other external services (collectively, "Third-Party Services").

Such services are provided by independent third parties.

Almy does not own or control Third-Party Services and is not responsible for their availability, functionality, accuracy, security, privacy practices, or content.

Your use of Third-Party Services may be subject to separate terms, privacy policies, and agreements established by those providers.

You acknowledge that Almy shall not be responsible for any loss or damage arising from your use of Third-Party Services.

The inclusion of Third-Party Services does not imply endorsement by Almy.

12. Privacy

Your privacy is important to us.

Our collection, use, storage, sharing, and protection of personal information are governed by our Privacy Policy, which forms an integral part of these Terms.

By using the Services, you acknowledge that you have read and understood our Privacy Policy.

You agree that we may process your information as described therein.

Where required by applicable law, we will obtain your consent before processing certain categories of personal information.

You remain responsible for ensuring that you have the legal authority to provide any personal information relating to a child or another individual through the Services.

13. Copyright and Intellectual Property Rights

Almy respects the intellectual property rights of others and expects users to do the same.

If you believe that any content available through the Services infringes your copyright or other intellectual property rights, you may submit a written notice containing:

  • - identification of the copyrighted work;
  • - identification of the allegedly infringing material;
  • - sufficient information to locate the material;
  • - your contact information;
  • - a statement that you have a good faith belief that the disputed use is unauthorized;
  • - a statement that the information provided is accurate;
  • - your signature or the signature of your authorized representative.

Upon receipt of a valid notice, we may investigate the claim and, where appropriate, remove or disable access to the allegedly infringing material.

Knowingly submitting false intellectual property claims may result in legal liability.

14. Feedback

We welcome suggestions, ideas, comments, feature requests, bug reports, and other feedback regarding the Services ("Feedback").

You are under no obligation to provide Feedback.

If you voluntarily submit Feedback, you grant Almy a perpetual, irrevocable, worldwide, non-exclusive, transferable, sublicensable, royalty-free license to use, reproduce, modify, adapt, publish, distribute, display, translate, commercialize, incorporate, and otherwise exploit such Feedback for any lawful purpose without compensation, attribution, or further permission.

You represent that your Feedback does not infringe the rights of any third party.

Almy has no obligation to implement or respond to any Feedback.

15. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

TO THE FULLEST EXTENT PERMITTED BY LAW, ALMY DISCLAIMS ALL WARRANTIES, REPRESENTATIONS, AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING, WITHOUT LIMITATION: MERCHANTABILITY; FITNESS FOR A PARTICULAR PURPOSE; SATISFACTORY QUALITY; NON-INFRINGEMENT; ACCURACY; COMPLETENESS; RELIABILITY; AVAILABILITY; QUIET ENJOYMENT; TITLE.

WITHOUT LIMITING THE FOREGOING, ALMY DOES NOT WARRANT THAT: THE SERVICES WILL ALWAYS BE AVAILABLE; THE SERVICES WILL OPERATE WITHOUT INTERRUPTION; THE SERVICES WILL BE FREE FROM BUGS, ERRORS, OR DEFECTS; DEFECTS WILL BE CORRECTED; THE SERVICES WILL BE COMPATIBLE WITH EVERY DEVICE OR OPERATING SYSTEM; INFORMATION PRESENTED THROUGH THE SERVICES WILL ALWAYS BE ACCURATE, COMPLETE, CURRENT, OR SUITABLE FOR YOUR INDIVIDUAL CIRCUMSTANCES; REMINDERS, NOTIFICATIONS, OR ALERTS WILL ALWAYS BE DELIVERED AT THE INTENDED TIME; DATA STORED WITHIN THE SERVICES WILL NEVER BE LOST, CORRUPTED, DELAYED, OR UNAVAILABLE.

YOU ACKNOWLEDGE THAT USE OF THE SERVICES IS ENTIRELY AT YOUR OWN RISK.

SOME JURISDICTIONS DO NOT PERMIT THE EXCLUSION OF CERTAIN WARRANTIES. IN SUCH JURISDICTIONS, THE FOREGOING EXCLUSIONS SHALL APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALMY, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, LICENSORS, SUPPLIERS, AND BUSINESS PARTNERS SHALL NOT BE LIABLE FOR ANY: INDIRECT DAMAGES; INCIDENTAL DAMAGES; SPECIAL DAMAGES; EXEMPLARY DAMAGES; CONSEQUENTIAL DAMAGES; LOSS OF PROFITS; LOSS OF REVENUE; LOSS OF BUSINESS OPPORTUNITIES; LOSS OF GOODWILL; LOSS OF DATA; LOSS OF USE; BUSINESS INTERRUPTION; PERSONAL DECISIONS MADE BASED ON INFORMATION PROVIDED THROUGH THE SERVICES; MEDICAL DECISIONS; MISSED REMINDERS; FAILURE TO RECEIVE NOTIFICATIONS.

WHETHER ARISING IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALMY'S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF: THE TOTAL AMOUNT PAID BY YOU TO ALMY DURING THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR USD $100.

NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT LEGALLY BE EXCLUDED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR FRAUD, INTENTIONAL MISCONDUCT, OR DEATH OR PERSONAL INJURY CAUSED BY GROSS NEGLIGENCE WHERE SUCH LIMITATION IS PROHIBITED.

17. Indemnification

You agree to defend, indemnify, and hold harmless Almy, its affiliates, directors, officers, employees, contractors, licensors, and partners from and against any claims, liabilities, damages, judgments, losses, costs, expenses, or legal fees arising out of or relating to:

  • - your use of the Services;
  • - your User Content;
  • - your violation of these Terms;
  • - your violation of applicable law;
  • - your infringement of any third - party rights;
  • - information submitted by you concerning a child or another individual;
  • - misuse of your account by you or anyone using your login credentials.

We reserve the right to assume the exclusive defense of any matter subject to indemnification by you, in which case you agree to cooperate fully with our defense.

18. Term and Termination

These Terms become effective when you first access or use the Services and remain in effect until terminated.

You may stop using the Services at any time.

You may delete your account in accordance with the procedures made available through the Services.

We may suspend, restrict, or terminate your access immediately, with or without prior notice, if we reasonably believe that:

  • - you have violated these Terms;
  • - you have violated applicable law;
  • - your activities create security risks;
  • - your account is used fraudulently;
  • - continued provision of the Services becomes technically or legally impractical;
  • - termination is necessary to protect other users or the integrity of the Services.

Termination does not affect any rights or obligations that accrued prior to termination.

Sections relating to intellectual property, liability limitations, indemnification, governing law, dispute resolution, payment obligations, and any provisions which by their nature should survive termination shall remain in effect after termination.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Cyprus, without regard to its conflict of laws principles.

Where mandatory consumer protection laws of your country of residence apply and cannot legally be excluded, nothing in these Terms shall limit those mandatory rights.

Subject to applicable law, the courts located within the Republic of Cyprus shall have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services unless otherwise required by applicable consumer protection legislation.

20. Complaints and Dispute Resolution
